Privacy Policy

We at Visual Kraft Design and Stephanie Haas (‘We’, ‘us’, ‘our’) share this privacy policy with you as a user or viewer of VisualKraftDesign.   We comply with the New Zealand Privacy Act 1993 (the Act) when dealing with personal information. We want you to know how we use the information you share with us.


This privacy policy has been compiled to inform you how your ‘Personally identifiable information’ (PII) is used online by VisualKraftDesign. PII is information that can be used (on it’s own or which other information) to identify, contact, or locate an individual or identify an individual in context.  We process PII as a Data controller, as defined by the General Data Protection Regulation.

We are committed to protecting your privacy and the confidentiality of your personal information. Our policy is not just an exercise in complying with the law, but a continuation of our respect for you and your personal information.

We undertake to preserve the confidentiality of all information you provide to us, and hope that you reciprocate.

We reserve the right to change this privacy policy without notice and the change will apply from the date on which we upload the revised policy.  By using or viewing VisualKraftDesign you agree to it, regardless of whether or not you've read it.


As part of agreeing to this privacy policy, you agree that you are of 16 years or older.  We require the consent of a parent or guardian to collect personal information from children under the age of 16.

Personal Identifiable Information

What personal information do we collect?

When ordering or signing up on our site, you may be asked to enter the following information to help us personalize your online experience with VisualKraftDesign.  You may be asked to enter the following: Name, Email address, Mailing address, Phone number, Credit Card information, or other details.

When do we collect information?

We collect information from you when you place an order, subscribe to a newsletter, navigate the website, or enter information on our site via survey or marketing communication.

We can collect this information from third parties where you have authorized this or the information is publicly available.  If possible, we will collect personal information from you directly.


You may decline to provide certain information to us, in which case we may not be able to provide you access to certain features and functionalities of the site.  

Once your information enters the public domain, we have no control over what any individual third party may do with it. We accept no responsibility for their actions at any time.


How do we use your information?

We may use the information we collect in the following ways:

  • Name:  To address you appropriately and verify your identity.

  • Email Address:  To serve as a point of contact (including complaint resolution), to share information and materials with you including marketing.

  • Mailing address:  To ship your purchased orders

  • Phone number: To aid in efficient order deliveries

  • Credit Card information: To process your orders securely

  • To conduct research and statistical analysis (on an anonymised basis) 

  • To protect and/or enforce our legal rights and interests, including defending any claim 

  • For any other purpose authorised by you or the Act.


How do we protect your information?

We use regular Malware scanning to detect security holes and known vulnerabilities in order to make your visit to our site as safe as possible.

Your personal information is contained behind secured networks and is only accessible to a limited number of persons who have special access rights to such systems. These persons are required by contract to keep the information confidential. In addition, all sensitive/credit information you supply is encrypted via Secure Socket Layer (SSL) technology.

All transactions are processed through a gateway provider and are not stored or processed on our servers.


We retain your information for as long as required to respond to and resolve inquiries and to process and share relevant information with you about ordered products. It is important that the personal data we hold about you is accurate and current. Please keep us informed if your personal data changes. For mailing list subscriptions, we retain your information for as long as you remain subscribed (i.e. you do not unsubscribe).


In compliance with Fair Information Practices we will take the following responsive action, should a data breach occur:

  • We will notify you via email within 7 business days.


Affiliate and business partner information

This is information given to us by you in your capacity as an affiliate of us or as a business partner.

It allows us to recognise visitors that you have referred to us, and to credit to you commission due for such referrals. It also includes information that allows us to transfer commission to you.

The information is not used for any other purpose.

We undertake to preserve the confidentiality of the information and of the terms of our relationship.

We expect any affiliate or partner to agree to reciprocate this policy.


Accessing and correcting you personal information

Subject to certain grounds for refusal set out in the Act, you have the right to access your readily retrievable personal information that we hold and to request a correction to your personal information. Before you exercise this right, we will need evidence to confirm that you are the individual to whom the personal information relates. 


In respect of a request for correction, if we think the correction is reasonable and we are reasonably able to change the personal information, we will make the correction. If we do not make the correction, we will take reasonable steps to note on the personal information that you requested the correction. 

Provided your request is reasonable and there is no legal basis for us to retain it, then at our discretion we may agree to your request to delete personal information that you have posted.  

If you want to exercise either of the above rights, email us at visualkraftdesign@gmail.com with the subject “Privacy Policy”. Your email should provide evidence of who you are and set out the details of your request (e.g. the personal information, or the correction, that you are requesting).This is important to safeguard your information.

 We may charge you our reasonable costs of providing to you copies of your personal information or correcting that information.

Credit reference

To assist in combating fraud, we share information with credit reference agencies, so far as it relates to clients or customers who instruct their credit card issuer to cancel payment to us without having first provided an acceptable reason to us and given us the opportunity to refund their money.


Complaints 

regarding content on our website

We attempt to moderate user generated content, but we are not always able to do so as soon as that content is published.If you complain about any of the content on our website, we shall investigate your complaint.If we feel it is justified or if we believe the law requires us to do so, we shall remove the content while we investigate.

Free speech is a fundamental right, so we have to make a judgment as to whose right will be obstructed: yours, or that of the person who posted the content that offends you.

If we think your complaint is vexatious or without any basis, we shall not correspond with you about it.


How you can complain

If you are not happy with our privacy policy or if you have any complaint then you should tell us.

If a dispute is not settled then we hope you will agree to attempt to resolve it by engaging in good faith with us in a process of mediation or arbitration.

If you are in any way dissatisfied about how we process your personal information, you have a right to lodge a complaint.  We would, however, appreciate the opportunity to talk to you about your concern before you approach other parties. Complaining

When we receive a complaint, we record all the information you have given to us.

We use that information to resolve your complaint.

If your complaint reasonably requires us to contact some other person, we may decide to give to that other person some of the information contained in your complaint. We do this as infrequently as possible, but it is a matter for our sole discretion as to whether we do give information, and if we do, what that information is.

We may also compile statistics showing information obtained from this source to assess the level of service we provide, but not in a way that could identify you or any other person.

While we take reasonable steps to maintain secure internet connections, if you provide us with personal information over the internet, the provision of that information is at your own risk. 


If you follow a link on our website to another site, the owner of that site will have its own privacy policy relating to your personal information. We suggest you review that site’s privacy policy before you provide personal information.

Google, as a third-party vendor, uses cookies to serve ads on our site. Google’s use of the DART cookie enables it to serve ads to our users based on previous visits to our site and other sites on the Internet. Unsubscribe/ opt out


You reserve the right to opt-out of receiving future emails. If you wish to do so: Follow the instructions located at the bottom of each email. We will remove you from all correspondence.

The Unsolicited Electronic Messages act 2007 sets rules for commercial email, establishes requirements for commercial messages, gives recipients the right to unsubscribe from emails, and indicates the penalties for violations.

We collect your email address in order to:

  • Send information, respond to inquiries, and/or other requests or questions.

  • Process orders and to send information and updates pertaining to orders.

  • Send you additional information related to your product and/or service.

  • Market to our mailing list or continue to send emails to our clients after an original transaction has occurred.

In accordance with Unsolicited Electronic Messages act 2007, we agree to the following:

  • Not use false or misleading subjects or email addresses.

  • Identify the message as an advertisement in a reasonable way.

  • Include the physical address of our business or site headquarters.

  • Monitor third-party email marketing services for compliance, if one is used.

  • Allow users to unsubscribe by using the link at the bottom of each email.
