Terms of Use

A - Our Policy

These Terms of use (‘Terms’, ‘Tos’, ‘terms of service’) apply to your use of the Visual Kraft Design Website and all cited content, provided by Visual Kraft Design (‘We’, ‘us’, ‘our’).


By viewing or using this site, you acknowledge and agree to these Terms and our Privacy Policy, regardless of whether or not your’ve read them.  We reserve the right to change these Terms without notice.


Our Website or Blog may contain our service marks or trademarks as well as those of our affiliates or other companies, in the form of words, graphics, and logos. Your use of our Website, Blog or Services does not constitute any right or license for you to use our service marks or trademarks, without the prior written permission of Stephanie Haas.

Our Content, as found within our Website, Blog and Services, is protected under New Zealand and foreign copyrights. The copying, redistribution, use or publication by you of any such Content, is strictly prohibited. Your use of our Website and Services does not grant you any ownership rights to our Content.


All files and information on this Website or Blog are copyright by Stephanie Haas, and may not be duplicated, copied, modified or adapted, in any way without our written permission.


Users must be 16 years of age or older, be aware that this website is covered by copyright laws locally and in foreign countries.  Those who access this site from outside Australia and New Zealand do so at their own risk and are responsible for complying with local laws.

B - General data protection regulation rights

You agree to and recognise the rights granted to you in accordance with the general data protection regulation, as details in our privacy policy.


If you feel the rights granted to you have been violated, you agree to contact Stephanie as soon as possible at visualkraftdesign@gmail.com with ‘Privacy Policy’ in the subject line.

C - Intellectual Property

All content shared and displayed on Visual Kraft Design is the property of Stephanie Haas unless otherwise cited.  Our products are copyright protected and remain the property of Stephanie Haas. All products created sold or distributed at Visual Kraft Design are optimised for digital use with the respective software and applications. We cannot provide support or guarantee that these products will work on other applications, or devices than that which is specified. We cannot provide refunds. Purchase at your own risk and review each product listing carefully. We are not affiliated with Apple, adobe or the apps we create products for and are not responsible for them or how they effect your devices.
Commercial Use
You may view all content for non-commercial use.  You agree not to use, alter, publish, or display our content, in part or in whole, for commercial use; Unless the item specifically states or we have prior agreed upon a written license contract with you. For surety, please review each product listing terms of use in the descriptions.  Unauthorized use may violate copyright laws.
Policy
Our products are copyright protected and are the property of Visual Kraft Design. Purchase of a digital file from Visual Kraft Design does not transfer rights to the buyer. By purchasing this product you are agreeing to our terms of use that you may not share, loan, publish or resell these products free or for sale. This product is for personal use only. All products are protected by New Zealand and foreign copyright laws.

D - Etiquette

While using or viewing this site, you agree not to:

  • Use the site in a manner that may disrupt or impair the sites functionality or any user’s experience of the site.

  • Intercept data or personal information from the site

  • Share or distribute any information containing harmful components intended to disrupt or impair the Site

  • Threaten, harass, or harm persons associated with Visual Kraft Design or other site users

  • Share or distribute any content considered by us to be objectionable, by law or otherwise

  • Inappropriately advertise, solicit, or promote material in violation of the Unsolicited Electronic Messages Act 2007.

  • Share, distribute, or solicit private information such as phone numbers, email address, postal address, or financial details

  • Misrepresent yourself with the intention of violating these terms

E - Warranties

The VisualKraftDesign site and content are provided on an ‘as is’ and ‘as available' basis.  To the extent permitted by the law, VisualKraftDesign makes no warranties with respect to our site or content.  We do not warrant our site or its functions will be uninterrupted. We do not warrant our site or content will be error free, nor do we warrant that errors will be corrected.  

 

Due to the nature of digital delivery we cannot provide refunds. Please inquire about product before making your purchase to avoid purchasing something that doesn’t work for you or your device.


 

No Waiver

Any failure on our part to act on or enforce any section of these Terms does not constitute a waiver of any of these Terms.

F - Commissions

If you have a problem with any of these terms, they may be changed if discussed with me prior to paying for your commissioned piece.

1. GENERAL TERMS

  • All drawings may or will include a subtle sign that you may not remove.

  • I might record the drawing process and post it on my youtube.

  • Prices are subject to change based on demand.

  • I have the right to reject any order that I do not feel comfortable drawing for any reason.

  • You will need a valid email to discuss your commissioned piece with me.

  • My commissions may not be first in first served.

  • My email is open to all business enquires - visualkraftdesign@gmail.com please feel free to contact with any questions.

  • Quotes are valid to 6 months, even if my prices don't increase in that time, you will need to get a new quote from me after this time.

  • Licensing my work - If you wish to make money from your commission, (eg, make stickers/put on shirts/use for advertising) please let me know when quoting as a licensing fee (depending on use) will be added.  If you wish to use a current original artwork on your products please email me - visualkraftdesign@gmail.com - to discuss.

2. PAYMENT

 

  • Currency accepted is either USD or AUD or NZD and can be paid through Stripe, Ko-fi or New Zealand or Australian bank transfer if needed. 

  • Commissions can be paid either 100% upfront or split 50% upfront and 50% after sketch approval.

  • Don't send me any payment before I have agreed to give you a slot and requested you to send me the payment.

  • Payment plans are to be discussed before invoicing.

  • If you wish a commission to be rushed or completed by a certain date, a rush fee of 50% may be added depending on the circumstances.

3. NSFW

​

  • NSFW commissions are only available from me through this page

  • You must be 18+ to commission NSFW material, please don't be offended if I ask for some ID.

  • I will attempt to do most things, but NSFW is not my main focus.

  • All NSFW will incur a slight fee as I will have to do more work to find a pose that I am confident with.  I will refuse anything I am not comfortable with.

  • If the commission piece has characters in it that are the IP of another person, I may contact them to get permission to complete the Illustration if this isn't provided to me in our initial conversation.

I will not draw 

​

  • Anything suggesting homophobic, pedophilic, zoophilic, transphobic, racist or generally disrespectful.

  • Babyfur characters in NSFW situations or pin ups

  • Underage characters in NSFW situations or pin ups

  • Necrophilia

  • Scat/Watersports/Vomit

  • Vore

  • Abuse

  • Bukkake

  • Character inflation

If you are unsure where your commission may fit in all this, it is best to send me a email.  I will be happy to let you know if it's something that I can do.

4. PROCESS AND DELIVERY

 

  • I will notify you when I have started on your commission and you, therefore, lose the rights to a refund (see point 7 further below for more info on refunds)

  • While I'm working on your commission I will make reviews with you to make sure I make it just right for you!

  • The amount of reviews depends on the complexity of the work.

  • During the reviews, you will see work-in-progress and these images will usually include a watermark and be smaller than the finished piece.

  • The time it takes to finish your commission varies 1 week - 3 months depending on factors such as health, the complexity of the commissioned piece, other work and con seasons.

  • If anything comes up that will slow the progress of the initially estimated delivery time I will let you know asap.

  • Once the piece is finished you will receive the full-resolution image along with a web-friendly size. Note that there is not always a physical product. This will be disclosed under the commission type. ( Depending on where you live, we can arrange to print your artwork. Just ask :)

5. REVISIONS

 

  • You get 2 rounds of changes on the commissioned piece included in the price unless otherwise stated.

  • A fee will be added if you want something changed on the final drawing - unless a misunderstanding from my side has been made.

  • If you wish for me to change something in the drawing you have previously approved, I will charge you a fee to change it. The amount of the extra charge depends on the change you want me to make and is usually based on an hourly rate.

  • If your reference is unclear to start with changes will come at an extra charge.

  • If the requested change will incur a extra cost, ie, if the commissioner wants the next tier of commission level, I will let you know that there will be a added charge.

  • Quick sketch's or speedpaints commissions may not receive WIP pics as these will be done rather fast.

  • During the sketch phase is when most of the revisions will take place, please let me know asap if you notice that I am missing any markings or other features. Changes to pose or big anatomy changes after finished will result in a fee.

  • Red lining - it is rude to have another artist complete a red lining of the completed commission without my expressed consent (this will only be granted in special circumstances).  You are commissioning me to illustrate in my own style, which may be very different from someone else's as a design choice.

6. COPYRIGHT / USAGE POLICY


I, Stephanie Haas / visual Kraft Design (the artist), claim the rights to the produced drawing, not the buyer. Therefore I am allowed to use the copyrighted artwork to:

 

  • Promote myself with it everywhere

  • Publish books with it (artbooks, etc.)

  • Display it everywhere to my liking (website, social media, etc.)

  • Post it wherever I want

  • If the commission piece has characters in it that are the IP of another person, I may contact them to get permission to complete the Illustration.  This is mostly be in the case of NSFW or suggestive/pinup poses.

  • Anonymous/Private commissions - I am happy to be asked to keep a commission anonymous and private if it is a gift or if it is a NSFW piece you are uncomfortable having shared.  If it only needs to be kept private for a short amount of time (as for a birthday gift) please let me know when this will be so I can post the work as well.  If you want this piece to be 100% private, there will be a fee added to this as I will not be able to use it for self promotion


The buyer is allowed to:

 

  • Use the commissioned piece for personal use unless agreed otherwise (you can upload it on all your social media profiles, forums, etc.)

  • Print the artwork and claim the character(s) as their own, but not the artwork itself.

  • Use the artwork to promote themselves. You are not forced to give me credit when you post it but it is very appreciated.

  • Use the artwork on their Youtube channel and in monetized videos as long as the artwork itself is not the main subject for the earnings.


The following is considered copyright infringement:

 

  • Reproducing/using the copyrighted artwork commercially - means making money off it in any way.

  • Claiming the artwork as your own

  • Removing my signature from the artwork

  • Altering the artwork without my consent

 

  • I reserve the full rights to the image and it's use/distribution unless otherwise agreed upon (rights to the image for your own non-personal use may be purchased at any time).

7. CUSTOMER SATISFACTION

 

  • I will do everything I can to make my customers happy!

  • If you have a problem with anything in regards to the commissioned piece please tell me right away so we can find a solution together.

  • I am willing to change some of my terms for you if you ask before I start on your commission. If you, e.g., do not want me to post your art anywhere, we can discuss this.

8. REFUND / CANCELLATION POLICY

 

  • The buyer is not allowed a refund once I start working on the commission.

  • If for any reason I am unable to start your commission you will receive a full refund.

  • If you cancel your order before I started it, you can get a full refund.

  • If you are getting a refund, do not request a Stripe chargeback. I will transfer the money back to you myself.

  • If you request a Stripe chargeback at any point when you were not allowed to ask for a refund you will lose all beforementioned rights to the commissioned piece and I will have the full right to profit further from it in any way. I will decline the chargeback and supply Stripe with our conversations in which we talk about the commission as evidence that I have completed work for you. Furthermore, you will be blacklisted for commissioning me again.

  • If the commission hasn't progressed past a sketch I will only refund 50%.

If the buyer breaks any of the points stated above they will lose all the beforementioned rights to the artwork commissioned by me, Stephanie Haas / visual Kraft Design /  XDarkKrafterX (the artist), and I will have the right to profit further from the commissioned artwork in any way I see fit. If you have a problem with any of these statements, they may be changed if discussed with me via email prior to paying your commissioned piece.

What do you get?

 

  • Drafts/mockups that you must decide which one I should continue with (depending on the complexity of the commission there might be fewer or more drafts)

  • Sketch and/or final sketches that you must accept before I continue the work

  • Insight and involvement in color plan (depending on the complexity of the commissioned piece)

  • Full-resolution file (approx. 210 x 297 mm at 300 DPI) of final drawing and a smaller version for internet upload. Final file formats are usually PNG.

  • A5 traditional Commissions will be A5 in size (150 x 210 mm) and can either be scanned in and a .PNG emailed to you or needs to be posted (unless collection priorly arranged).  A postage address will need to be provided. Please do so via form when applying.

  • If your address needs to be amended please email me ASAP to let me know, as this is the change of personal information, you are required to also include your full name, address you originally supplied and email address as per the commission form (if you are emailing from the same email address, I just require your name and both address's).  I ask this to protect your privacy, to see more on why I do this, see my Privacy Policy.
